Current Trends in Legislation – June & July 2025

Federal Legislature

    • Two new bills were introduced.
    • One bill addresses the regulation of PFAS in drinking water and the other seeks to establish an official to coordinate efforts to address PFAS within the Department of Defense.

State Legislature

  • Ten bills were introduced across three states.
  • Topics include: appropriations that include funds for PFAS remediation and management; comprehensive PFAS bans; minor amendments made to existing bills modifying language pertaining to PFAS

State Regulations

  • Washington regulation WSR 25-13-093 became effective 7/18/2025. This adopts the National Primary Drinking Water Regulations (40 C.F.R. Part 141) and has adjusted various regulations to align these sections with the recent changes to 40 C.F.R. Part 141 regarding PFAS.

      Signed into Law

      •HP 681 (ME) was signed into law. This establishes MCLs for certain PFAS in drinking water.
      •HP 1197 (ME) was signed into law. This requires the DEP to provide information regarding PFAS to the public and to private well-water owners.
      •H5844 (RI) was signed into law. This requires quarterly testing of biosolids for PFAS contaminants.
      •H238 (VT) was signed into law. This act begins a comprehensive phaseout of PFAS in consumer products.
      •H5019 (RI) was signed into law. This bill outlines a comprehensive PFAS ban in consumer products. The bill was signed into law in 2024, but additions were made.
      •HB2947 (OR) was signed into law. This bill appropriates money for Oregon State University to study PFAS in biosolids and declares an emergency.

          • Bill Name: A bill to codify national drinking water regulations

          • Summary: This bill aims to codify national drinking water regulations for PFAS, though the language is general at this stage.
          Federal Bill: H.R. 3761
          • Bill Name: A Bill to direct the Secretary of Defense to designate a Coordinator for Engagement 
          • Sponsors: Brian Fitzpatrick

          • Status: Introduced
          • Summary: This bill requires the Department of Defense (DOD) to designate an official as the Coordinator for Engagement with Defense Communities Affected by PFAS. Specifically, the official must (1) improve the outreach, education, and communication efforts of DOD with respect to current or former defense communities located in the United States that have been affected by the contamination or leakage of PFAS, and (2) serve as a dedicated liaison between DOD and local governments, advocacy organizations, and individual citizens in such communities where DOD has ongoing or incomplete PFAS remediation projects. PFAS are man-made and may have adverse human health effects.

          • Bill Name: Protecting Pennsylvanians by Banning PFAS in Certain Products

          • Summary: This bill will prohibit the use of PFAS in cosmetics, dental floss, juvenile products, and menstrual products. The restrictions and prohibitions would not go into effect immediately such that manufacturers have an opportunity to adjust and comply.
          State Bill: SCM 47046 (PA)
          • Bill Name: PFAS Firefighting Foam  
          • Sponsors: Gene Yaw
          • Introduced: 6/30/2025
          • Status: Pre-bill memorandum
          • Summary: The proposed legislation would place restrictions on the manufacturing, sale, distribution, and use of firefighting foam containing PFAS beginning in 2026. It would also permit fire companies to use their Fire Company and Emergency Medical Services Grant funding for the disposal of this foam. Additionally, the legislation would require the State Fire Commissioner to collaborate with the Department of Environmental Protection (DEP) to ensure proper disposal methods are followed.
          State Bill: HP 1325 (ME)
          • Bill Name: An Act to Ensure Uniformity in the Regulation of PFAS 
          • Sponsors: Amy Arata
          • Introduced: 6/3/2025
          • Status: This was accepted 6/4/25.
          • Summary: This bill changes the definition of “PFAS” in the laws governing reduction of toxics in packaging, the sale of products containing intentionally added PFAS.

          State
          HB1153 (MD) was approved by the Governor 5/9/2024. This bill establishes limits for PFAS in any water discharged by industrial entities.
          S25 (VT) was approved by the Governor 5/30/2024. This bill prohibits the sale of certain products, including cosmetics, mistral products, and textiles containing intentionally-added PFAS.

          Amaran Toppa joined CMBG3 Law in 2017 after almost three years in the investment management industry. In addition to her time in the financial sector, Mrs. Toppa has over 15 years of experience working with law firms who have litigated and consulted on ESG, Environmental, Insurance, Toxic Tort, Criminal and Civil matters. As a member of the CMBG3’s Government Affairs team, Mrs. Toppa analyzes and provides guidance on important policy and regulatory issues to the firm’s practice groups.           Tori Paiva is a Legislative Analyst at CMBG3 Law specializing in ESG, PFAS, Environmental and Tort issues. Ms. Paiva has extensive knowledge and expertise pertaining to federal regulators bodies including OSHA, EPA, DEP, and the FDA. With her expertise on both federal and local regulations, she has helped with the national defense strategies for her clients and continues to inform our attorneys on pertinent issues developing in the regulatory realm. As a member of the Government Affairs team, she is responsible for monitoring and reporting on legislative priorities, and regularly attends congressional hearings.
