- There was a new pre-rule introduced regarding PFAS reporting per Toxic Substances Control Act. This will be a revision to the existing regulation per 40 CFR 705. Source documents are not available at this time, but EPA plans to propose the incorporation of certain exemptions and other modifications to the scope of the reporting rule.

•HB2409 (IL) was signed into law 8/15/25. This amends the Illinois Environmental Protection Act and provides that beginning 1/1/2026, an entity, including an importer or domestic distributor of firefighting personal protective clothing containing intentionally added PFAS chemicals, shall provide written notice to the purchaser at the time of sale which shall state: (i) that the fire protective clothing contains PFAS chemicals; and (ii) the reason PFAS chemicals are added to the clothing. The bill prohibits a person that sells auxiliary firefighting personal protective equipment to any person, local government, or State agency from knowingly manufacture, sell, offer for sale, distribute for sale or distribute

State Bill: HB 4357 (MA)

- Summary: This bill requires the creation of lists of toxic chemicals of concern and high-priority chemicals in children’s products, with specific requirements for manufacturers to notify the department of chemical use, especially for PFAS and other hazardous substances. It establishes a process for evaluating safer alternatives and requires manufacturers to either remove or substitute high-priority chemicals, with stricter restrictions on products that foreseeably will be near children’s mouths or marketed to children under three.

- Summary: This bill prohibits the manufacture, sale, distribution, or application of certain agricultural materials containing PFAS above specified concentration thresholds in counties with populations between 175,000 and 195,000. Manufacturers in such counties must submit monthly samples to the Texas A&M AgriLife Extension Service for PFAS testing, and batches exceeding limits must be disposed of through hazardous waste methods. The bill also designates a Class A misdemeanor for violating these limits, which becomes a state jail felony if the offender has prior convictions under the same law.
