Federal Legislature

    • One new bill was introduced, which seeks to accelerate the development of PFAS-free equipment for firefighters.

State Legislature

  • Eighteen bills were introduced across eight states.
  • Topics include: Health screenings; MCLs in drinking water; comprehensive PFAS bans.

State Regulations

  • ME 06-096 Ch. 90 was published 5/7/2025. This establishes criteria for currently unavoidable uses of intentionally added PFAS in products and implement the sales prohibitions and notification requirements for products containing intentionally added PFAS but determined to be a currently unavoidable use pursuant to the amended 38 M.R.S. § 1614.

      Signed into Law

      •HB 167 (NH) signed into law. The bill prohibits the sale of ski, boat, and board waxes that contain intentionally added PFAS.
      • SB 91 (OR) signed into law. The bill prohibits fire departments from using PFAS firefighting foam in Oregon.
      • SB 5033 (WA) signed into law. The bill requires local governments to implement biosolid management protocol relating to sludge, with attention to the presence of PFAS.
      • SP 419 (ME) signed into law. The bill provides certain exemptions from PFAS restrictions, specifically clarifying that the exemption does not apply to any textile article or refrigerant that is included in or as a component part of such products. The exemption applies to certain products containing PFAS, including motor vehicle equipment, off-highway vehicles, specialty motor vehicles and personal assistive mobility devices.
      • SP 66 (ME) signed into law. This bill requires the Department of Agriculture, Conservation and Forestry to establish the PFAS Response Program for the purpose of abating, cleaning up and mitigating threats and hazards posed by PFAS that affect agricultural producers in the State and the food supply; providing support to affected commercial farms; supporting critical PFAS research; and allowing for the department to strategically and effectively respond to PFAS concerns and issues as they arise.

          • Bill Name: An Act to Ensure Uniformity in the Regulation of PFAS

          • Summary: This bill changes the definition of “PFAS” in the laws governing reduction of toxics in packaging and the sale of products containing intentionally added PFAS, to align with the United States Environmental Protection Agency’s definition of “PFAS.”

          • Summary: The bill generally aligns Maine’s regulation of PFAS to Federal regulations. Specifically, the bill establishes soil concentration levels for PFAS for the purposes of determining when land is contaminated by PFAS; requires that Maine establish a maximum contaminant level equivalent to the standards of the EPA’s national primary drinking water regulations adopted in April 2024; stipulates that federal regulations on PFAS in food-packaging preempts state authority on the same.

          • Summary: The bill is a comprehensive PFAS ban that establishes requirements and prohibitions for sale and distribution of certain products containing intentionally added PFAS. Products include, but are not limited to: apparel, cosmetics, food packaging, juvenile products, women’s hygiene products.

          • Bill Name: An Act to amend the environmental conservation law

          • Summary: The bill seeks to ban the sale of products with intentionally added PFAS. The bill requires that a manufacturer of a product for sale in the state that contains PFAS as intentionally added chemicals shall comply with the requirements set forth. The bill exempts products that are governed by federal law and products whose PFAS falls under the unavoidable use provision.

          HB1153 (MD) was approved by the Governor 5/9/2024. This bill establishes limits for PFAS in any water discharged by industrial entities.
          S25 (VT) was approved by the Governor 5/30/2024. This bill prohibits the sale of certain products, including cosmetics, mistral products, and textiles containing intentionally-added PFAS.

          Amaran Toppa joined CMBG3 Law in 2017 after almost three years in the investment management industry.           Tori Paiva is a Legislative Analyst at CMBG3 Law specializing in ESG, PFAS, Environmental and Tort issues. Ms. Paiva has extensive knowledge and expertise pertaining to federal regulators bodies including OSHA, EPA, DEP, and the FDA. With her expertise on both federal and local regulations, she has helped with the national defense strategies for her clients and continues to inform our attorneys on pertinent issues developing in the regulatory realm. As a member of the Government Affairs team, she is responsible for monitoring and reporting on legislative priorities, and regularly attends congressional hearings.
