Significant Changes To Prop 65 Regulations

Regulatory changes are on the horizon for California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (known as “Prop 65”) that may impact any company that does business in California, including any product sales through third-party platforms into the state, at a cost of hundreds of thousands or millions of dollars.

The Prop 65 regulatory agency, the California Office of Environmental Health Hazard Assessment (OEHHA), proposed significant revisions to its “clear and reasonable warnings” regulations for “short-form” consumer product warnings. These changes will impact the content and transmission of the warnings and create a new compliance challenge and liability risk that can carry civil penalties of up to $2,500 per violation – for a single product violation, for sales dating back one year, that could potentially add up to over $1 million in fines, plus attorney fees sought by a private enforcer.

The Public Comment period on the regulatory changes closes on March 29, 2021 and a Public Hearing will take place on March 11, 2021.
